Changes to the MLS Rules and Regulations for the 07-2019 version are below:
1) Section 1.2 (b)
Contact and branding information may only be placed in fields designated for such, or in REALTOR® Remarks
Section 1.2 (c)
Properties entered into the Residential Class that are not designated by age to be “new construction” shall submit a minimum of five (5) photographs immediately and no later than five (5) business days after the listing is submitted to the MLS. It is recommended these images include: Front Elevation, Rear, Parking, Kitchen & Living areas. MLS staff is also authorized to remove any photos found to be in violation of 1.2.(b) above.
Meaning, any listing input from August 1st, 2019 forward must contain a minimum of 5 photos of the property. Additionally, if a photo contains contact or branding information MLS staff is authorized to remove it.
2) Beginning August 1st the acreage field will become a required field.
3) The following have been added to Section 25.9 Administrative Violations & Fine Schedule. Meaning, violations of these rules will now receive automatic fines.
Section 1.2(c) – A minimum of five (5) photographs are required on Residential listings that are not new construction.
Section 24.2.2-3 – Keyholder Use Restrictions
4) The following sections have been updated to ensure compliance with NAR policy.
Section 18.1 has been amended to include “Even where participants have given blanket authority for other participants to display their listings on IDX sites, such consent may be withdrawn on a listing-by-listing where the seller has prohibited all Internet display or other electronic forms of display or distribution.”
Section 18.3.7 & 18.3.8 have been amended to include “For audio delivery of listing content, all required disclosures must subsequently be delivered electronically to the registered consumer performing the property search or linked to through the device’s application.”
